By using the Hotels & Hostels system, you agree to accept and adhere to the Hotels & Hostels Property Terms outlined below. Contact us if you have any questions.
- Read these terms and conditions carefully as they form a binding agreement between Lonely Planet Publications Pty Ltd ABN 36 005 607 983 of 90 Maribyrnong Street, Footscray, Victoria, 3011, Australia (Us, We, Our) and the company or person (You, Your) stated in the inventory management system (IMS) operated by Us in conjunction with the Lonely Planet online accommodation booking service (Hotels & Hostels) and relates to the property (Property) stated in the IMS.
- If You do not agree with the terms and conditions then You must not register for, or participate in, Hotels & Hostels. If You no longer wish to participate in Hotels & Hostels then please contact Us.
Key terms
- The key terms of this agreement are:
- Hotels & Hostels will facilitate Travellers to book accommodation directly with You;
- You will update Your inventory and pricing details in the IMS;
- You must pay us an amount equal to 10% of the total cost of a booking which We will collect from
the Traveller as your agent at the time a booking is made and will be non-refundable;
- If you do not honour a booking, You must organise alternative accommodation and transfers and
ensure that Travellers are not out of pocket;
- If a booking is cancelled on less than 24 hours notice You can charge the Traveller for the first night’s accommodation if credit card details have been provided;
- We may remove Your Property, temporarily or permanently, from Hotels & Hostels at any time;
- You will be responsible for the payment of all indirect taxes in relation to the provision of accommodation to a Traveller;
- You must reimburse Us if We are required to pay any indirect taxes in relation to the Service Fee, other than Australian GST; and
- If the Property is removed from Hotels & Hostels, You must honour all existing bookings.
How We provide Hotels & Hostels
- We will:
- list the Property on Hotels & Hostels and provide a facility to enable Travellers to make Bookings;
- provide an independent review of the Property on Hotels & Hostels;
- operate, and give You access to, the IMS so You can update the inventory and pricing details
of the Property; and
- supply You with reference materials and training for Hotels & Hostels and the IMS.
How We provide Hotels & Hostels (cont)
- When a Hotels & Hostels Traveller books accommodation at the Property (Booking), the Booking constitutes a contract for provision of accommodation between You and the Traveller. You agree that We have no responsibility for fulfilment of Bookings and the contract for accommodation is between You and the Traveller.
Booking, payment & room rates
- You must use your best endeavours to offer Hotels & Hostels Travellers the best available room rate for the Property at the time of the Booking, where rates are at least as good as the prices offered to anyone else for equivalent rooms at the Property.
- The room rates are to be inclusive of all taxes (local and national) and other fees.
- On making a Booking, a Traveller will be required to pay 10% of the total amount payable for the Booking (calculated as the number of nights booked at the quoted room rate and including taxes). The Traveller will pay You the balance of the total amount payable for the Booking by direct arrangement with You upon arriving at the Property.
- We will collect and retain the 10% payment, as your agent, as part of the consideration payable by the Traveller for the Booking. This 10% payment is not refundable to You or the Traveller even if a Traveller is a “no show” or cancels the Booking, or if You do not honour the Booking. We may apply the 10% payment against the service fee payable by You in consideration for Our services provided in giving You access to Hotels & Hostels and facilitating the Booking which is currently an amount equal to 10% of the total amount payable for the Booking (Service Fee).
- We may change the level of the Service Fee at any time. If we increase the level of the Service Fee, we will give you 30 days’ written notice.
- If a Traveller cancels a Booking at least one clear day in advance of the first day of the Booking, You
must accept the cancellation without penalty (for example, if the first day of a Booking is the 10th of March,
the Traveller has until midnight on the 8th of March in the place where the Property is located, to cancel the Booking without penalty).
- If a Traveller makes a Booking and is a “no-show” or cancels the Booking less than one clear day in advance of the first day of the Booking and You have been provided with the Traveller’s credit cards details, You will be entitled to charge the Traveller for the first night’s accommodation at the relevant room rate, less the Service Fee paid for the first night. When a Traveller makes a Booking, We will make the Traveller’s credit card details available to You if required to hold a Booking. We have no obligation to reimburse You if You are unable to recover the value of the first night’s accommodation from the Traveller’s credit card details.
- You must not use a Traveller’s credit card details other than as specified above. You indemnify us for any losses, liabilities or expenses incurred by Us, and We may immediately remove the Property from Hotels & Hostels, as a result of the misuse of a Traveller’s credit card details.
Booking Types
- Any rooms allocated in Your inventory calendar are considered to be a 'Guaranteed' inventory which means that a Traveller can make a Booking through Hotels & Hostels without being subject to confirmation by You. It is important to always update Your inventory to ensure there are no double bookings.
- If You have not allocated any rooms in Your inventory calendar We will still list the Property on Hotels & Hostels and We may allow Travellers to place requests for Bookings through Hotels & Hostels (Request). The Request will be emailed to you asking you to confirm or decline the Request. If you have not responded within 48 hours the Request will be automatically cancelled. A Traveller may cancel a Request at any time prior to You confirming the Request with Us without penalty.
Taxes
- You are responsible for remitting all taxes payable on the total amount of the Booking to the responsible authority.
- If the Property is located within Australia, the Service Fee is inclusive of GST (as defined in A New Tax System (Goods and Services Tax) Act 1999). We will be responsible for remitting the portion of the Service Fee that relates to GST to the Australian Taxation Office.
- If We are, or become, liable for any indirect taxes on the Service Fee, other than Australian GST, You must reimburse Us for Our entire tax liability. If a tax liability arises, We will provide You with a tax invoice for the Service Fee to assist You to claim a tax rebate upon request.
What you will do to participate in Hotels & Hostels
- You will:
- properly process and honour all Bookings;
- require Travellers to produce valid photo identification when arriving at the Property;
- provide Us with an accurate amenities list for the Property;
- update the inventory and pricing details of the Property on the IMS on a continual basis;
- notify Us immediately of any change to the contact details for You or the Property;
- ensure that the Property is in compliance with all applicable laws and regulations and have appropriate health, safety and fire policies in place; and
- maintain appropriate insurance cover with a reputable insurer in relation to public liability and other risks in accordance with industry standards.
- If requested, You will provide photos of the Property to Us which You own or are licensed to use.
You license Us to use, and authorise Our affiliates to use, these photos on Hotels & Hostels or in any
promotional materials.
- You indemnify Us against any liabilities, costs or expenses incurred by Us arising out of or related to a claim by a Traveller except to the extent that the liability, cost or expense is caused by Our negligent acts.
- You must not use the Lonely Planet or Hotels & Hostels name or logo or any other intellectual property owned
by Us without Our prior written consent. This includes not copying any of the content on Hotels & Hostels such
as property reviews.
Overbooking & overcharging
- If You do not honour a Booking, You must provide the Traveller with alternative accommodation of an equal or better standard in a similar location, with similar facilities and style for the term of the Booking and:
- cover the cost of transfers to the alternative accommodation; and
- ensure the Traveller is not out of pocket if the cost of the alternative accommodation exceeds the cost
of the Booking.
- You must charge Travellers no more than the amount quoted, by You within the IMS, to the Traveller when the Booking was placed less an amount equal to the Service Fee collected by Us.
- If You:
- do not honour a Booking on 2 separate occasions; or
- overcharge a Traveller,
- then We can immediately remove the Property from Hotels & Hostels.
- This agreement will continue until terminated by either party giving the other party 30 days’ written notice.
- We may either suspend, or permanently remove, the Property from Hotels & Hostels at any time, including if You:
- fail to comply with Your obligations under this agreement;
- fail to provide a satisfactory service to Travellers; or
- provide Us with inaccurate information in relation to the Property.
- Despite the Property being removed from Hotels & Hostels, whether temporarily or permanently, You must honour all outstanding Bookings. We will confirm outstanding Bookings with You upon termination or suspension.
Miscellaneous
- We may change these terms and conditions, or withdraw these terms and conditions and impose
new terms and conditions, by giving You 30 days’ written notice.
- We have no liability to You in respect of any loss, liability or expense that You may incur in relation
to Hotels & Hostels or any Bookings.
- These terms and conditions, and the manner in which the IMS operates, are strictly confidential.
- We may, but are under no obligation to, list the Property in any travel guide books published by Us.
- If anything in these terms and conditions is unenforceable, illegal or void then it is severed and the rest
of this agreement remains in force.
- A notice or other communication connected with these terms and conditions has no legal effect unless
it is in writing and delivered to the addressee by hand, pre-paid postage, facsimile or electronic mail.
- These terms and conditions constitute the entire agreement and understanding between Us and You.
- These terms and conditions are governed by the laws of the State of Victoria and the Commonwealth
of Australia.
